Florida DUI Penalties

When you are arrested for a DUI charge, you will be issued a Uniform Traffic Citation by the arresting officer. But do not let this fool you. A DUI charge is not merely a traffic infraction, it is a criminal charge that carries serious and harsh mandatory penalties. The outcome of your case will depend greatly on the facts of your case and whether you have any prior alcohol related driving offenses.

First Time DUI Offense

A conviction for a first-time DUI offense will result in a fine of $500 - $1,000; a period of probation of one-year; up to 180-days in jail; drug and alcohol counseling and treatment; DUI classes; a minimum of 50-hours of community service; 10-day impoundment of your motor vehicle; and a driver's license suspension of 6-months to 1-year.

Second Time DUI Offense

A conviction for a second-time DUI offense within 5-years of a prior conviction will result in a fine of $1,000 - $2,000; a minimum 10-days of incarceration; a period of probation up to one-year; mandatory installation of an ignition interlock device for one-year; drug and alcohol counseling and treatment; DUI classes; 30-day impoundment of your motor vehicle; and a 5-year driver license suspension.

Third Time DUI Offense

A conviction for a third-time DUI offense within 10-years of a prior conviction can be filed as a third-degree felony. A third-degree felony is punishable by a fine up to $5,000; a minimum of 30-days of incarceration; a period of probation up to 5-years; mandatory installation of an ignition interlock device for two-years; drug and alcohol counseling and treatment; DUI classes; and a driver's license suspension of 10-years.
