A conviction for a second-time DUI offense within 5 years of a prior conviction will result in a fine of $1,000 - $2,000; a minimum of 10 days of incarceration; a period of probation up to one year; mandatory installation of an ignition interlock device for one-year; drug and alcohol counseling and treatment; DUI classes; 30-day impoundment of your motor vehicle; and a 5-year driver license suspension.
Third-Time DUI Offense
A conviction for a third-time DUI offense within 10 years of a prior conviction can be filed as a third-degree felony. A third-degree felony is punishable by a fine of up to $5,000; a minimum of 30-days of incarceration; a period of probation up to 5 years; mandatory installation of an ignition interlock device for two years; drug and alcohol counseling and treatment; DUI classes; and a driver's license suspension of 10-years.
